These Terms and Conditions (“Terms”) govern your access to and use of the Zoop+ Charge mobile application, website, and physical EV charging infrastructure (collectively, the “Services”), owned and operated by Atlasgate Global Trading Private Limited (“Company”). 

  1. ACCEPTANCE OF TERMS

By registering an account or using any Zoop+ Charge station, you agree to be bound by these Terms. If you are using the Services on behalf of a company or fleet, you represent that you have the authority to bind that entity. 

  1. USER REGISTRATION AND ACCOUNT SECURITY
  • Eligibility: You must be at least 18 years of age and possess a valid driving license for an electric vehicle. 
  • Accuracy: You agree to provide accurate vehicle details (Make, Model, License Plate). Incorrect vehicle data may lead to charging inefficiencies for which the Company is not liable. 
  • Security: You are responsible for maintaining the confidentiality of your App credentials. Any session initiated through your account is deemed your financial responsibility. 
  1. CHARGING SERVICES & USAGE
  • Availability: While we strive for 100% uptime, the Company does not guarantee the availability of any specific charger at any specific time. 
  • Safety Compliance: Users must follow all safety instructions displayed at the charging station boards or within the App. This includes proper handling of connectors and ensuring the vehicle is properly parked. 
  • Charging Compatibility: It is the user’s responsibility to ensure their vehicle is compatible with the selected charger (e.g., CCS2 or Type 2). The Company is not liable for damages resulting from incompatible hardware use. 
  1. PAYMENTS, TARIFFS, AND REFUNDS
  • Pricing: Tariffs are subject to change based on location(State-wise), time of day, and electricity regulatory norms. Current rates will be displayed in the App prior to the start of a session. 
  • Wallet & Billing: Users must maintain a minimum balance or link a valid payment method. All transactions are processed through third-party gateways. 
  • Refunds: In the event of a technical failure (e.g., power cut after payment or faulty hardware), users may apply for a refund within 48 hours via the “Help” section of the App. Refunds will be credited to the original payment source or Zoop+ Wallet. 
  1. USER CONDUCT & PROHIBITED ACTS

Users agree not to: 

  • Tamper with, dismantle, or vandalize charging hardware. 
  • “ICEing”: Parking a non-electric vehicle in a designated Zoop+ Charge bay. 
  • Overstaying: Occupying a charging bay after the vehicle has reached 100% charge or the session has ended. The Company reserves the right to charge “Idle Fees” for such occupancy. 
  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Atlasgate Global Trading Private Limited shall not be liable for: 

  • Electrical Issues: Damage to the vehicle’s battery or electronics caused by power surges, grid fluctuations, or Force Majeure events beyond the Company’s control. 
  • Third-Party Locations: Damages, theft, or accidents occurring at host premises (e.g., malls, apartments, or fuel stations) where our chargers are installed. 
  • Indirect Damages: Any loss of profits, data, or business interruption resulting from the inability to use a charger. 
  1. INTELLECTUAL PROPERTY

The “Zoop+ Charge” name, logo, software licence and UI design are the exclusive property of Atlasgate Global Trading Private Limited. Unauthorized reproduction or reverse engineering of the App is prohibited. 

  1. TERMINATION

We reserve the right to suspend or terminate your account without notice if: 

  1. You breach these Terms. 
  1. Your usage patterns indicate fraudulent or hazardous activity. 
  1. You fail to clear outstanding dues. 
  1. FORCE MAJEURE

The Company shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Company’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including “line noise” interference). 

  1. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Indore, where the Company’s registered office is situated.
